New Presidential Executive Orders with Mixed Results for Canadian Businesses

On February 21, President Trump issued two key Presidential Actions that will likely have mixed implications for Canadian businesses.

The “America First Investment Policy” modifies the U.S. government’s approach to inbound and outbound foreign investment, with the aim of increasing investment from allies and partners while also tightening investment restrictions against countries that are deemed by the U.S. to be foreign adversaries, including China. These new investment rules may create new opportunities for Canadian firms looking to invest in the U.S.

“Defending American Companies and Innovators From Overseas Extortion and Unfair Fines and Penalties” sets out the Trump administration’s intention to investigate and levy tariffs against Canada and any other countries that it views as unfairly implementing digital service taxes (DSTs) against U.S. companies. This new Presidential Memo further highlights that Canada’s digital services tax is a major irritant for the U.S., and that it will continue to be a counterproductive policy that the government should aim to reverse.
